This is the draft of what I sent off to Circuit city. This letter is in regards to a rebate offer on one of your products just before Christmas 2003. The offer was to buy a Western Digital 120G Hard Drive (HD1200JR) for $139.99 and receive the following three rebates: YB270 for $40, YB272 for $30, and YB273 for $40. All of these rebates were printed from the Circuitcityrebates.young-america.com website on Dec 22 of 2003. The purchase date had to be no later than Dec. 24th, 2003. The Item was ordered online VIA Ticket # 441701382729 on Dec. 22nd, 2003 and pick up at your Southfield, MI Store #3610. All rebates were submitted and received by Circuit City on Jan 12th, 2004. YB270 and YB272 have been approved but YB273 was not. The reason stated was that the item was not purchased in the offered dates for this rebate. I called the rebate line at 1-888-213-9761 and once I explained my situation, the woman said that she was aware of this issue and it was being directed to Corporate. I called corporate on Jan 29th, 2004 at 1800-251-2665 and opted out for a Customer Service Rep. Heather advised that this offer was only valid on Dec 11, 12 of 2003 and there was a mistake with the Rebate YB273 still being available after that date. Diane stated the rebate would not be honored. I went back to my records and did some research and found that the offer was said to expire on Dec 24th, 2003. I checked my purchase dates, the rebate forms, and the post mark dates to make sure I didn’t miss any of them. Rebate Form YB273 does not list the required purchase dates, none of your rebate forms do, However. I printed them all on the same date of Dec. 22, 2003. So, it was still listed on the circuitcityrebates.young-america.com website. I called back to Corporate on Jan. 30th, 2004 and spoke with Diane. Diane sadi there was a memo that was sent out VIA email regarding this issue. She read it as we were on the phone an confirmed the same conversation I had with Heather the previous day, that in fact, the rebate SHOULD have been taken down and was not a valid offer. I asked to speak to a Manager since to me this becomes an error on behalf of Circuit City/Young America, not the consumer. Diane tried to transfer me but she came back and said that all the managers were busy and she would take my number and have them call me back within 24 hours. I received no call back. Jan. 31st 2004 I called and spoke with Gwen and went over the same information as the previous two calls and I just asked her to speak to a manager again. She said she could see that I was due to receive a call back and I should just wait. I requested that she resubmit my request for a call back and confirmed my call back number. I never did receive a call back on Feb. 1st either. I called Corporate back on Feb 3rd and explained the issue once again and was finally transferred to a manager, Diane Beverly, at Ext 6780. She apologized and explained the same scenario that Young America did not take the rebate down as it should have. The rebate YB273 will not be honored and there was no more she could do. I tried to explain that if this was an error on Young America’s part, it would seem that it should be dealt with them not the consumers who shop at your stores. All she would do is apologize. I requested to escalate another level up over her and she stated, “ I am the highest”. That was the end of the call. I have shopped quite a bit at Circuit City due to the atmosphere and customer service compared to other stores. I have purchased computers, Large TV’s and TV stands, DVD players, etc. I am utterly disappointed on how this issue is being handled due to an error from your store/affiliates. I even requested a compromise from Diane Beverly for a Gift Card. “No Sir” was the response I received. As a consumer with many choices to buy the same products, I find this very uncaring and a bit of bad customer service. As an investor in Stocks and such, I know Circuit City can’t afford to lose many customers. Which, In all honesty, if why I have continued to shop there. I prefer Circuit City to the “other” store. I would like a reasonable resolution to this issue. I am very frustrated that 1. An error regarding a rebate is not being honored although it was an error on your part. 2. I did not receive a call back as promised. 3. I did not receive a call back on the second request for such either. 4. When I even suggested a compromise, there was none. I will be happy to shop elsewhere if this is how Circuit City values it’s customers. I look forward to a response at your earliest convenience. If no reasonable conclusion can come of this issue. I will file a complaint with the Better Business Bureau for not honoring an offer than was available in error or not constitutes fraud.

I filed a complaint with the FTC and this was the response I got: quote:
Thank you for your correspondence to the Federal Trade Commission regarding rebates offered by companies. Rebate offers and coupons are, among other things, a form of price competition. While some manufacturers or sellers may conclude that simple price discounts will attract customers, others may believe that a rebate or coupon program will be a more effective means of advertising substantial savings to consumers. In general, no statute enforced by the Commission addresses the decision to adopt a rebate or coupon program. Thus, promoters of rebate or coupon plans use their independent business judgment in offering such plans to distributors or to the public. However, if a company decides to offer a rebate or coupon plan, it must fully disclose the material terms and conditions of the offer and must provide the promised rebate. If a company systematically fails to do so, it may be engaging in deceptive or unfair practices in violation of Section 5 of the Federal Trade Commission Act. Finally, you may wish to raise your concerns with the manufacturers or companies who offer rebates or coupons, since many companies appreciate comments from the public about their products and how they are marketed. You should also note that many companies hire independent companies to administer their rebate or coupon programs and are eager to hear about their performance. The Federal Trade Commission acts in the public interest to stop business practices that violate the laws it enforces. Letters from consumers and businesses are very important to the work of the Commission. They are often the first indication of a problem in the marketplace and may provide the initial evidence to begin an investigation. The Commission does not resolve individual complaints. The Commission does, however, act when it sees a pattern of possible violations developing. The decision to open up an investigative action depends on how widespread the practice is, how many consumers are hurt, how much harm is done, and how much evidence we have. We must also determine how much staff time and effort we can put into each case, and we must concentrate on the most urgent. We appreciate your taking the time to write.
